These Terms of Service (“Terms”) govern your access to and use of the StableOps platform, websites, APIs, and related services (the “Service”), provided by StableOps Inc. By using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.
By accessing or using the Service, you agree to be bound by these Terms and any policies referenced here, including our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old and capable of forming a binding contract. The Service is intended for businesses and is not offered where prohibited by law or applicable sanctions programs.
You are responsible for maintaining the confidentiality of your credentials and API keys, and for all activity under your account. You must promptly notify us of any unauthorized use. We may require identity or business verification before enabling certain features.
You agree not to use the Service to:
Fees are described in your order or on our pricing page and are billed per operation unless otherwise agreed. Fees are exclusive of taxes, which you are responsible for. Late amounts may accrue interest and result in suspension.
We work to keep the Service available and performant, and offer service levels in applicable enterprise agreements. We may modify, suspend, or discontinue features, and will provide reasonable notice of material changes where practicable.
We retain all rights in the Service and our underlying technology. You retain rights in your data. You grant us a limited license to process your data solely to provide and improve the Service, subject to our Privacy Policy.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Digital assets carry risk; we do not provide investment, legal, or tax advice.
To the maximum extent permitted by law, StableOps will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our aggregate liability arising out of or related to the Service is limited to the amounts you paid us in the twelve months preceding the claim.
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or as required by law. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. The exclusive venue for disputes is the state and federal courts located in New York County, unless your enterprise agreement states otherwise.
